It is not about the award of public contracts within the meaning of Directive 2014/24/EU or Sections 97 ff GWB. contractual partner kcan be any pharmaceutical company according to § 4 Abs. 18 AMG. According to the case law of the ECJ, such approval procedures are not necessarily subject to public procurement law, since there is no competition due to the lack of a selection decision.
