The present announcement serves to conclude drug discount agreements in accordance with § 130a Paragraph 8 SGB V for the active substance(s) mentioned under point II.1.1). It is not about the award of public contracts within the meaning of Directive 2014/24/EU or Sections 97 ff GWB. contractual partner kcan be any pharmaceutical company according to § 4 Abs. 18 AMG. According to the case law of the ECJ, such approval procedures are not necessarily subject to public procurement law, since there is no competition due to the lack of a selection decision. The notice serves as an invitation toconclusion of discount agreements with the same conditions that apply to all contractual partners and are non-dispositive, including the determination of the discount.
