  Testing digital care services for self-management of diabetes mellitus
  The subject of this procedure is the conclusion of the open house framework agreement "Testing Digital Care Services for the Self-Management of Diabetes Mellitus." The contract provides for the provision of information and services Consulting services by the contractual partner via digitale Provision for legally and / or privately insured patients with diabetes mellitus (ICD-10-GM-2019 code E10-E14).   The main contractor will be the patient treated by him with the clinical picture diabetes mellitus (ICD-10-GM-2019-Code E10-E14), in which the use of the by the Federal Ministry of Health (im Following: BMG) selected digital supply offers (in the following: DiVAs) from a medical point of view appears meaningful, in the time between contract conclusionand 31.3.2021 indicate the free use of the selected DiVAs. The contracting party will provide the patient with a registration code issued by the BMG for at least one of the DiVAs. Patients who have used a registration code and have communicated this to the contracting party, the contracting party in the application of the Patisupport diVA, actively integrate this DiVA into the treatment process and regularly, at least at the end of each calendar quarter, obtain feedback from the patients on the use of the DiVA. The contractor agrees to a quarterly feedback survey on the recommendation and application of the DiVAs and at least one training eventParticipate in the selected DiVAs on Diabetes mellitus (ICD-10-GM-2019-Code E10-E14).
  All physicians may apply for membership of the framework contract at any time during the entire duration of this framework contract by submitting a bid. Accession to the framework contract or conclusion of contract takes place if the tenderer accepts the stipulated contractual conditionsrt, his offer is complete and he fulfills the eligibility criteria listed below (section III).
  The individual call-off from the framework contract is made by a request for performance by the BMG in text form in accordance with the order of the conclusion of the contract. A claim of the doctor to a single call does not exist. More detailed information about the single call mode from the framework contract is availableThe final outcome of this framework contract is subject to the condition precedent that at least one supplier of such an offer should be included in the tendering process for tenders for up to three DiVAs (document number 223-547169 in the Supplement to the Official Journal of the European Union) wins the contract and thus at least one DiVA a
  1) Approval of the tenderer as a doctor, proof is given by self-declaration with submission of bid
  2) Membership of the tenderer in the Berlin Medical Association, proof is given by self-declaration with submission of offer
  This publication does not concern the awarding of a public contract or a framework agreement within the meaning of Directive 2014/24 / EU. DIt is published in the Supplement to the Official Journal of the European Union in order to achieve the highest level of transparency. In the absence of a corresponding Notice Form, the contract notice form will be used in accordance with Directive 2014/24 / EU. A further meaning, in particular a submission under procurement regulations, is thus not verbunden. Against this background, in addition to what is stated in Section VI.4.3 of this contract notice (lodging of appeals), the following points should be taken into account:
  1) The open procedure procedure under Section IV.1.1 of this contract notice (type of procedure) is due to the use of this form The conclusion of the framework agreementis in an open house procedure. An open procedure does not take place.

A selection of tenders according to award criteria will not take place, contrary to what is stated in Section II.2.5) (award criteria) of this contract notice. The claim is due to the fact that the form requires an indication of the award criteria.
  7) Since the provisions of Part Four of the GWB nare not applicable, the legal recourse to the public procurement tribunals is not opened. As a precautionary measure, the body responsible for ensuring compliance with the public procurement rules is mentioned in Section VI.4.1 of this contract notice (Responsible body for appeal / review procedure)
