  Non-exclusive drug discount agreements according to - 130a Abs. 8 SGB V with possibility to finalize the active substance fosfomycin (WHO code: J01XX01)

  The subject matter of this publication is the conclusion of Non-exclusive discount agreements according to - 130a Abs. 8 SGB V for drugs to the active substance fosfomycin (ATC code naWHO (J01XX01)) within the framework of an "open-house model." All interested and suitable pharmaceutical companies are offered a discount agreement in accordance with section 130a (8) SGB V, subject to uniform terms and a uniform access procedure The purchase quantity is unknown upon conclusion of the agreement and espIt depends, in particular, on the demand of insured persons, the development of the number of insured persons, on the prescribing behavior of contracted doctors and on the dispensing and stocking behavior of public pharmacies. The client guarantees no minimum order quantities.

  The conclusion of the agreement may at any time andon the same conditions. Individual contract negotiations will not be carried out.
  Interested pharmaceutical companies may request the participation documents (discount agreement and the form mentioned under III.1.1) via the e-mail address mentioned under I.1).
  Agreements under this model will be made in the period from 18.6.2019 to 31.7.2021 closed. interefor the first time until 17.6.2019 and thereafter until the 15th of each month at the office specified under I.1). It depends on access to the AOK PLUS. Falls the 15th of a month on a Saturday, Sunday or nationwide lawpublic holiday, the next working day will take the place of such day. In the event of late arrival (after 17.6.2019 or 15th of each month), the participation documents submitted will be taken into account on the 15th of the following month.
  The discount agreement will enter into force on signature of both parties until 31.7.2019 on 1.8.2019. If the date of signing is dhe AOK PLUS after 31.7.2019, this discount agreement will come into effect as soon as the AOK PLUS has signed the discount agreement upon receipt of the complete documentation signed by the pharmaceutical company.
  The signing will take place until the end of the month in which the participation documents are enclosed AOK PLUS must be received.
  Organizationally, there is a lead ofabout half a month from the AOK PLUS necessary to make the notifications of the discount agreement. The initial labeling of the discount drug in the pharmacy software takes place from the second month following the submission deadline of the participation documents. In case of changes or redefinitions of the deadlines for the key date reports in the nationwide AOK contract reporting portal DatRabatt kThis time may vary. A discount agreement will be concluded with all pharmaceutical companies complying with the conditions of participation and confirming this with their signature on the requested documents.
  The contract will end no later than 31.7.2021, irrespective of the date of the conclusion of the contract. The AOK PLUS reserves itself, the open-house procedure in particular in theCase of the conclusion of exclusive discount agreements to end prematurely. In this case, the contracts already concluded shall terminate in accordance with the contractual provisions. According to AOK PLUS experience, exclusive rebate agreements usually take place eight to 12 months after the publication of the relevant call for tenders in the Supplement to the Official Journal of the EuropeEuropean Union in force. Future contractors in the open-house model are invited to consult regularly in the Supplement to the Official Journal of the European Union.
