  Conclusion of a non-exclusive rebate agreement pursuant to Section 130a (8) SGB V on the active substance oxycodone naloxone, ATC code: N02AA55, for the period from 1.8.2019 to 31.7.2021
  This notice is for the purpose of concluding Pharmaceutical discounts pursuant to Section 130a (8) SGB V on the active substance (s) referred to under II.1.1. It is not the Verpublic service contracts within the meaning of Directive 2014/24 / EU or -- 97 ff GWB. The contracting party can be any pharmaceutical entrepreneur in accordance with - 4 para. 18 AMG. According to the case law of the European Court of Justice, such authorization procedures are not necessarily subject to public procurement law, as no competition takes place due to the lack of a selection decision. The notice serves as a solicitationg to conclude discount contracts with conditions that are identical and non-disposable for all contractual partners, including the determination of the discount. The contract is concluded by signing the contract documents and submitting the required declarations, which can be requested from the contact point named under I.3).
  The earliest date of the contract is 1.8.2019the signed contract and the required declarations have been received by the contact point named under I.3) by 10.7.2019. This refers to the information in IV.2.2). In the event of later receipt, the commencement date of the contract is the 1st of the month, which refers to the month of receipt of the signed contract as well as the required declarations or proofs for the account named under I.3)If the entry is made by the 5th of each month, otherwise the 1st of the next month. The contracts end automatically, without the need for termination, as soon as contracts for the active substance (s) or the active substance combination (s) are concluded as part of a procurement procedure. The contracts expire on 31.7.2021.
