  Conclusion of a non-exclusive rebate agreement pursuant to section 130a (8) SGB V on the active substance colistimethate sodium, ATC code: J01XB01, for the period from 1.8.2019 to 31.7.2021.
  This notice is intended to conclude of drug rebates in accordance with Section 130a (8) SGB V on the active substance (s) referred to under II.1.1 (e). It is not theProcurement of public contracts within the meaning of Directive 2014/24 / EU or -- 97 ff GWB. The contracting party can be any pharmaceutical entrepreneur in accordance with - 4 para. 18 AMG. According to the case law of the European Court of Justice, such authorization procedures are not necessarily subject to public procurement law, as no competition takes place due to the lack of a selection decision. The announcement serves as a requestconclusion of discount contracts with the same and non-disposable conditions for all contracting parties including the determination of the discount. The contract is concluded by signing the contract documents and submitting the required declarations, which can be requested from the contact point named under I.3).
  The earliest date of the contract is 1.8.2019 if the signed contract and the required declarations have been received by 10.7.2019 at the contact point named under I.3). This refers to the information in IV.2.2). In the case of later receipt, the commencement date of the contract shall be the first of the month, which refers to the month of receipt of the signed contract and the required declarations or proofs under I.3)Contact office, provided the entry is made by the 5th of each month; otherwise the 1st of the next month. The contracts end automatically, without the need for termination, as soon as contracts for the active substance (s) or the active substance combination (s) are concluded as part of a procurement procedure. The contracts end on 31.7.2021.
