Description:
The subject of the contract to be concluded are securities-related financial services in the form of financial portfolio management by a financial service provider. The estimated total value is above the applicable threshold of EUR 221,000.
The service to be commissioned in this caseis a "financial service" within the meaning of Section 116 Paragraph 1 No. 4 GWB. Since the requirements of Section 116 Paragraph 1 No. 4 GWB are met, Part 4 of the GWB is inapplicable, in its entirety. Accordingly, there is no obligation under procurement law to carry out the contract in question within the framework of a contractcompetitive tendering process. This result corresponds to the meaning and purpose of Section 116 Paragraph 1 No. 4 GWB. The reason for the exception is that financial services usually require a special relationship of trust between the parties andon the other hand, the capital market is particularly volatile and fast-moving. The client also relies on this special relationship of trust within the scope of the contract in question. Therefore, a financial service provider should be commissioned outside of a GWB procurement procedure.
