Refo-Plan 2025: "Scientific support for legal protection in environmental affairs at international, European and national level in the 21st legislative period"
In the project, the monitoring of the association lawsuits of environmental and nature conservation associations for the period 1/24 to 12/27 and thus ensure the empirical basis for the continuous evaluation of the effect of the environmental association lawsuit. At the same time, more recent legal developments at national, European and international level be examined. The consequences of ongoing and pending jurisprudence of the German courts, in particular the BVerwG, and the ECJ for legal protection in environmental affairs for Germany are to be assessed for legal protection. From the same point of view, the consequences should also the saying practice of the Aarhus Compliance Committee for the UN ECE-Aarhus Convention for Germany. Furthermore, the effects of the upcoming amendment to the Environmental Rights Affords Act and possible legal issues should be raised in the legislative procedure be further developed. Suggestions for the federal legislature for the further development of the association's claimant strumentation are to be developed on these basics. In addition, the results of the research project are to be validated by the specialist public, in particular through their presentation and discussion as part of the event series "Forum Environmental Law".
