Description:
On March 1st, 2022, changes to the Federal Nature Conservation Act (BNASCHG) came into force, which were passed in the course of the so -called Insect Protection Act. Among others, a new § 54 Paragraph 6a BNASCHG was supplemented by an authorization basis in favor of the Federal Ministry of the Environment. According to this, the use of insect traps outside of closed rooms can be limited or prohibited by the legal ordinance. Specifically, Section 54 (6a) BNatSchG is:
"(6a) The Federal Ministry for the Environment, Nature Conservation and Nuclear Safety is authorized to restrict or prohibit the use of insect traps outside of closed rooms by means of a law with the consent of the Federal Council for the protection of animals and plants. 1.
