• Under the umbrella of the UMK, joint funding from the federal and state governments is to be developed for tasks and measures in the area of ​​nature conservation and landscape management. According to current constitutional law, there is room for maneuver within the framework of the joint financing of the improvement of the agricultural structure in accordance with Article 91a Paragraph 1 No. 2GG. In addition, a constitutional amendment to introduce, among other things, a joint task (GA) “nature conservation” must be examined. The general framework conditions have already been determined for climate adaptation, among other things, and the simple legal design options but have not yet been sufficiently investigated in nature conservation. The same applies with regard to classification as an investment for green and blue infrastructure and for achieving climate neutrality. It is necessary to check which measures should be taken into account on other tasks of environmental protection, taking into account the constitutional terms “nature conservation” and “landscape management” (Art. 74 Para. 1 No. 29 GG) as well as the objectives of the BNatSchG in the scope of application of the new GA and, if necessary, the credit authorization fall into the special fund according to Art. 143h GG and should fall from the perspective of (federal) nature conservation.
