• Description:
• The aim of this legal opinion is to examine the 2. Aircraft noise protection regulation with regard to the current state of noise effects, structural sound insulation and aviation technology. In particular, legal change and further development needs should be shown and concrete, Legal proposals are developed in particular in order to adapt the structural sound insulation claims to the current technical and scientific state of knowledge and consequently to further develop the cost refund regulations with regard to more contemporary, structural sound insulation. For this purpose, the current status and the development potential in structural sound protection technology must be analyzed, in particular with regard to technical synergy potential in the area of cold and heat (back) extraction technology and other technical processing in the building ventilation and -Heaing technology. In addition, questions of flexibility and efficiency of the implementation of the 2nd Aircraft Noise Protection Ordinance should be checked in order to enable a quick and more flexible handling of the reimbursement claims for the beneficiaries.
  As part of the legal opinion, both Legal aspects as well as practical application questions and the current enforcement experiences and obstacles are considered in the respective federal states. Building on the knowledge and recommendations obtained, the reports on the "Evaluation of the 2nd Aircraft Noise Protection Ordinance" (UBA Texts 13/2016) and the report of the Federal Government of 2019 (first report by the Federal Government to evaluate the law to protect against aircraft noise (flight noise law)).
