Description:
1) The transport services are awarded as part of a competitive award procedure in accordance with Article 5 Paragraph (3) of Regulation (EC) 1370/2007. The ZVNL intends to award the transport services as part of a negotiated procedure with a competition. The application of the Article 5 Paragraph (3b) Regulation (EC)1370/2007 remains reserved. 2) The ZVNL will initiate the award procedure before the end of the one-year period in accordance with Article 7 Paragraph (2) of Regulation (EC) 1370/2007, but not before the expiry of 60 days from the publication of this preliminary information. 3) Operators are asked to express their intereste in the provision of the transport services to be awarded must be communicated to the contact point specified in Section I.1) within 60 days of publication of this preliminary information. 4) The awarding of transport services is subject to the provision of appropriate financial resourcestel. If and to the extent that the corresponding financial resources are not made available to the ZVNL, the ZVNL reserves the right to refrain from awarding the transport services or to cancel the award procedure. 5) The ZVNL is the responsible authority for regional rail transport in its area in accordance with Section 3 Abs. 2 Public transport law for the Free State of Saxony. The ZVNL is therefore the responsible authority within the meaning of Section 15 of the General Railway Act of December 27, 1993 (BGBl. I p. 2378, 2396; 1994 I p. 2439), which was last amended by Article 1 of the law of May 28, 2015 (BGBl . I p. 824) has been changed (AEG)....
