• The large -scale construction project "Center for Mental Health" (ZFSG) is funded in two separate funding measures with two construction phases in accordance with Article 11 of the Bavarian Hospital Act (BayKRG), so the project was shared in two construction phases. In order to have a procurement law and billing technologySeparation of the construction sections and thus ensure transparency and legal conformity with regard to the evidence and fundamentally uses, the funding agency specifies to formally separate the construction work into lots. In accordance with § 5 of the award and contract regulations for construction work(VOB/a) and § 97 of the law against restrictions on competition (GWB), both lots may be awarded together if this requires economic or technical grounds. If only individual lots are offered, the overall offer is not valuable and must be excluded. It is expressly pointed out that according to the construction phasesDifferentiated (partial) final invoices and acceptance are provided for both lots. The creation and invoicing must also be done easily. Addendums are to be created separately for lots. This procedure ensures that the project is economical, transparentand can be implemented technically efficiently.
