- The health insurance companies involved are pursuing the goal of signing discount agreements with all suitable pharmaceutical companies in accordance with Section 130a, Paragraph 8 of the Social Code Book V (for lots 1 and 2) and Section 130c, Section 1 of the Social Code Book V (for lot 3) for the active ingredients listed in the respective lot close. The contract is concluded within the framework ofOpen House Biologicals procedure of the health insurance companies involved:
Individual negotiations on the content of the contract are not conducted, uniform conditions apply. The cash registers involved do not guarantee individual contractual partners any exclusivity. The contract period is a maximum of 24 months startingwith 01.08.2023. The contract ends on July 31, 2025 at the latest, regardless of the date of the conclusion of the contract. Irrespective of this, this procedure for lot 1 and each contract concluded within the framework of this procedure for lot 1 ends automatically when the decision of the common federation comes into forceCommittee of June 15, 2023 on the amendment of the pharmaceuticals directive: "§ 40b (new) - Exchange of biotechnologically manufactured biological finished medicinal products by pharmacies for parenteral preparations for direct medical use".
For lot 3 also applies: When the patent expiresbefore July 31, 2025, the contract ends automatically at the end of the month in which the patent expires.
