Description:
The client Ruhr-Universitaet Bochum (hereinafter "client") is a corporation under public law. The client operates two natural gas-fired combined heat and power plants (hereinafter: large CHP and small CHP). The quantities of natural gas that the client purchases are subject to thenational emissions trading system (nEHS) according to the Fuel Emissions Trading Act (BEHG). As a supplier, the client is responsible according to § 38 Energy Tax Act within the meaning of § 3 No. 3, § 2 Para. 2 BEHG.
The large CHP is subject to the European emissions trading system. As part of the EU-ETS is the responsibility of the client as the system operator according to § 3 No. 4 TEHG. Therefore, in connection with the procurement and delivery of electricity, emission certificates for the CO2 emissions of the CHP must be procured in compliance with the European Emissions Trading Directive and the German TEHGto be paid to the responsible authority in a timely manner.
