Description:
On March 1st, 2024, the bankruptcy proceedings were opened by self -administration on the assets of Breitband Nordhessen GmbH (below "BNG"). In the course of this, it was decided to sell the broadband network (passive infrastructure), with the aim of achieving the highest possible sales proceeds.Otherwise it would be possible to sell the shareholders of the shareholders of Breitband Nordhessen GmbH if there was interest on the part of potential prospective buyers. The passive network was built from October 1st, 2016 to November 22, 2019 and in sections until 08.05.2020put into operation by the network operator. Funding (ELER funds from the State of Hesse and the federal funding program for broadband expansion based on the NGA framework regulation) were also used for the establishment. The respective purpose binding periods are currently not yetexpired. Current tenant of the entire passive broadband network is the Netcom Kassel Society for Telecommunications mbH (NCK). Since the NCK takes over the entire network operation within the framework of the lease, maintenance and interference of the network is also currently being carried out by the NCK. The buyer of theNetzes would have to enter into the lease agreement with the NCK, whose term at the earliest on September 21, 2036, when the extension option is pulled by the NCK at the earliest on September 21, 2041, would have to enter or bring in directly with the NCK.
