Used licenses at Oberberg Hospital As part of the planned procurement of Microsoft Office 2024 Standard LTSC licenses, it was checked whether the license requirement could be covered by existing Microsoft contract structures, in particular the BMI framework agreement (price scale D). can be covered. The audit has shown that these contract models generally only provide for the procurement of new Microsoft licenses via authorized contractual partners. The purchase of used software licenses is possible via these contract structures not planned, as this involves the resale of existing usage rights between market participants. According to the case law of the European Court of Justice (ECJ, judgment C-128/11 - UsedSoft), trading in used software licenses is permitted under certain conditions. However, the corresponding license transfers take place outside of the Microsoft contract structures. Against this background, it was decided to purchase used Microsoft Office 2024 Standard LTSC To examine volume licenses in a separate award procedure and to obtain corresponding offers from the market.
